Cray Inc. is committed to protecting and respecting your privacy. This Privacy Policy outlines our handling practices for personally identifiable information that we receive from users of our websites located at www.cray.com and www.yarcdata.com (collectively, the "Site" or "Sites"). This Privacy Policy may be updated from time to time for any reason. We will notify you of any material changes to our Privacy Policy. We suggest that you consult this Privacy Policy regularly for any changes. Continued use of the Site after we have notified you any such changes shall constitute your consent to such changes.

By using our Site you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing” means using cookies on a computer or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities may take place the United States as well as in other jurisdictions.

Information Collection and Use

Our primary goals in collecting personally identifiable information are to provide you with the services made available through the Site and to communicate with you.

This may happen in a number of instances, such as when you sign up for our webinars or to receive white papers or other materials, or send inquiries regarding our products or services. We will keep a record of such information, and may use your contact information to contact you in response to your inquiries, and to send you information regarding the Site and/or our products or services. If you decide at any time that you no longer wish to receive such information or communications from us, you may opt out by using the mechanism available on the Site, or by following the unsubscribe instructions provided in any of our communications to you.

When you visit the Site, our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). Log Data may include information such as your IP address, browser type or the domain from which you are visiting, the web pages you visit and the search terms you use. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. Except in the instances described herein, we do not use this information to identify you personally. We use it to monitor use of the Site and our service, and for the technical administration of the Site.

Cookies

Like many websites, we also use “cookie” technology to collect additional website usage data and to improve the Site and our service. Information Sharing and Disclosure

General. Except as set forth in this Privacy Policy, Cray will not share your personally identifiable information with any third parties.

Resellers and Partners. We may share your personally identifiable information with our resellers and partners, and such resellers and partners may use your information to market our products and services.

Service Providers. We may engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance services, customer relationship services, including service providers that may use your information to market our products and services, and database storage and management services. We will share your personally identifiable information with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the confidentiality of your data.

Compliance with Laws and Law Enforcement. Cray cooperates with government and law enforcement officials or private parties to enforce and comply with the law. Subsidiaries. We may share your personally identifiable information within Cray or with any of our worldwide subsidiaries, which may use such information in accordance with this Privacy Policy.

We may transfer your personally identifiable information to Cray in the U.S., to any Cray subsidiary worldwide, or to third parties acting on our behalf for the purposes of processing or storage or other similar activities in accordance with this Privacy Policy. By using our Site and providing your personally identifiable information to us, you are consenting to any such transfer.

Changing or Deleting Information

If you wish to update or correct your information in our possession, you may do so by providing your updated information via the registration forms available on the Site.

Cray complies with the U.S.-EU Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information from European Union member countries. Our Policy Toward Children

The Site is not directed to persons under age 18. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact us at privacy@cray.com. If we become aware that a child under age 13 has provided us with personally identifiable information, we will remove such information from our files.
